Legal Issue Regarding Your Property

Legal issues as they relate to real estate can be very complicated. There is no one answer to all legal questions. Also, similar legal questions may have vastly different answers depending on the surrounding circumstances that may apply to the situation. For this reason a lawyer should be consulted whenever there is a legal issue regarding one of your real estate properties.

There is a wealth of information on the Internet relating to legal issues regarding real estate. Although there is a great deal of information available, care should be taken to verify that the information you find is both correct and applicable. When using the Internet for research it is certainly likely that you will come across erroneous information. For this reason, each piece of information should be verified through a reputable source. Another problem with using the Internet for researching legal issues is that you are likely to come across information that is outdated. This information may have been correct at the time of publication but it may not have been updated to reflect the most recent laws.

An example of a complicated legal issue regarding real estate is property that is damaged by the runoff from a nearby culvert. There are a number of factors that will contribute to whether or not a particular party is responsible for the damage or whether there is no one who is responsible for the damage. Some of the factors that need to be considered are whose property is the culvert located on, who had the culvert installed, was the culvert installed correctly or incorrectly and is the runoff a result of natural occurrences or the installation of the culvert.

Many property owners make the mistake of believing that their neighbors are automatically responsible for damage to their property if it stems from a feature on the neighbor's property. In the above example the existence of the culver in question on the property of the neighbor does not automatically make the neighbor responsible for damages that occur on nearby properties. If the city had the culver installed then they might be legally responsible for the damages. Even the construction company that constructed the culvert might be found responsible if it determined that the culvert was installed incorrectly and that the incorrect installation was the cause of the damage. Also, in some cases it may be found that the city is not responsible even though they installed the culvert and it is found that the culvert is in fact causing the damage. If it determined that the installation of the culvert was necessary to prevent more critical or extensive damage than the city may not be liable for the damages.
